These Terms and Conditions govern your use of holmesgrownusa.com and any order you place with us. Please read them before ordering. By placing an order or using this site, you agree to them.
In these terms, “Holmes Grown”, “we”, “us” and “our” mean Holmes Grown USA, LLC, a California limited liability company, of 532 Eldorado Drive, Escondido, California 92025, trading as Holmes Grown USA. “You” means the person using the site or placing the order.
1. Who can order
You must be at least 18 years old and able to enter into a binding contract. We sell and ship within the United States only. We are not able to accept orders for delivery outside the United States, including to freight forwarders who export.
2. Our products are grown, not manufactured
We are a working avocado grove. Fruit is picked to order rather than held in cold storage, which means a few things worth knowing before you buy:
- Availability follows the harvest. Varieties come in and out of season. A product shown as out of stock is not discontinued, it is simply not ready to pick.
- Size, colour and count vary. Boxes are sold by weight, not by a fixed number of avocados. The number of pieces in a box will vary with fruit size.
- Fruit arrives hard. Avocados are shipped unripe on purpose so they survive the journey. They typically need several days on the counter to ripen. Fruit arriving firm is not a defect.
- Photographs are representative. Product images show the kind of fruit you can expect, not the exact fruit you will receive.
3. Orders and acceptance
Your order is an offer to buy. A confirmation email acknowledges that we received it; the contract forms when we accept the order and prepare it for shipment.
We may decline or cancel an order, in whole or in part, including where the product is unavailable, the harvest falls short, there is an error in the price or description, we cannot deliver to the address given, or we suspect fraud or resale. If we cancel an order you have already paid for, we will refund it in full.
4. Prices, taxes and payment
Prices are in US dollars and are shown on the product page. California sales tax is calculated and added at checkout where it applies.
Payment is taken at checkout through our payment processor. We do not see or store your full card details. If a price is listed incorrectly, we will contact you before charging you and you may confirm the corrected price or cancel.
5. Promotional codes
Discount codes are single use per customer unless stated otherwise, cannot be combined unless stated otherwise, have no cash value, and may be withdrawn at any time. Codes issued to a named recipient are not transferable.
6. Shipping and delivery
We ship within the United States only. Delivery estimates are estimates, not guarantees, and we are not responsible for carrier delays, weather events or delivery disruptions outside our control.
Getting the address right matters more than usual. Fresh fruit is time sensitive. Please check your shipping address at checkout. We are not able to refund orders that are lost, delayed or spoiled because an incorrect or incomplete address was supplied, or because the parcel sat undelivered at the address for an extended period.
Merchandise ships separately. Hats, shirts and other printed merchandise are produced by a third-party print partner and dispatched from their facility, not from the grove. If you order fruit and merchandise together, they will arrive in separate parcels, on different schedules, and may carry separate shipping charges.
Risk of loss passes to you on delivery to the address you supplied.
7. Returns, refunds and our guarantee
Our satisfaction guarantee, the 48-hour window for reporting a problem with fresh produce, and the 30-day window for damaged or misprinted merchandise are set out in full in our Refund and Returns Policy, which forms part of these terms. Where anything here appears to conflict with that policy, the Refund and Returns Policy governs.
8. Food safety and allergies
Our avocados are a fresh, unprocessed agricultural product. They are not washed with sanitiser before dispatch, so wash fruit before eating as you would any fresh produce. Fruit is packed in a facility that handles tree fruit. If you have a food allergy, contact us before ordering. Nothing on this site is medical or dietary advice.
9. Recipes and growing information
Recipes, ripening guidance and growing articles on this site are shared in good faith for general information. Follow safe food handling practice, and use your own judgement. We are not liable for the outcome of a recipe or a growing decision.
10. Reviews and anything you post
If you leave a product review or submit content to the site, you confirm it is your own honest experience and that you have the right to share it. You give us permission to display, reproduce and quote it in connection with our business, including in marketing, without payment. We may decline or remove content that is unlawful, abusive, misleading, or not about the product.
11. Our content
The text, photography, recipes, logos and design on this site belong to us or our licensors and are protected by copyright and trade mark law. You may share links and quote short extracts with attribution. You may not copy our photographs, product descriptions or recipes onto another commercial site, or use our name or marks, without our written permission.
12. Accounts
If you create an account, keep your password confidential and tell us promptly if you believe it has been used without your permission. You are responsible for activity under your account.
13. Links to other sites
Where we link to another organisation we do so for your convenience. We do not control those sites and are not responsible for their content or their handling of your data.
14. Privacy
How we collect and use your information is set out in our Privacy Policy.
15. Availability of the site
We aim to keep the site available but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it, including products and prices, at any time.
16. Limits on our liability
Nothing in these terms limits liability that cannot lawfully be limited, including for fraud, or for death or personal injury caused by negligence, and nothing here affects your rights under the California Consumer Legal Remedies Act or other consumer protection law that cannot be waived.
Subject to that, and to the fullest extent permitted by law: the site and its content are provided as they are, without warranties of any kind beyond those we give expressly in these terms and in our Refund and Returns Policy; we are not liable for indirect or consequential loss, or for lost profits, lost data or business interruption; and our total liability in connection with any order will not exceed the amount you paid for that order.
17. Events outside our control
We are not liable for failure or delay caused by something beyond our reasonable control, including weather, fire, drought, crop failure, disease, water restrictions, strikes, carrier failure, power or network outages, or government action. Where such an event affects your order we will contact you, and you may cancel for a full refund of anything not yet shipped.
18. Governing law
These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in San Diego County, California, and you and we each agree to that venue.
19. General
If any provision of these terms is found unenforceable, the rest continues to apply. A delay in enforcing a term is not a waiver of it. These terms, together with our Refund and Returns Policy and Privacy Policy, are the entire agreement between us in relation to your order.
20. Changes to these terms
We may update these terms. The version in force when you place an order is the version that applies to that order. The date at the top shows when this version took effect.
